Terms of Service

These terms are between you and Homies, a product of Create & Source (“Homies”, “we”). By signing up for or using Homies you agree to them. If you are using Homies as a client of an agent, your agent's account is the subscriber and these terms apply to your use of their portal.

The service

Homies is a customer-relationship app for real estate agents: contacts, deals and their dates, documents, an inbox, in-app messages and calls, and a private portal for each of your clients. Accounts are approved by us before they are turned on.

Subscription and payment

Homies is a monthly subscription per agent, billed in advance. Prices are shown before you subscribe and any change is announced at least 30 days ahead. You can cancel at any time; the subscription runs to the end of the paid month. Unpaid accounts move to read-only after the grace period we tell you about, and are deleted 90 days later unless you export or reactivate. Referral credits are applied to future months and are never paid in cash.

AI-assisted drafting

Homies suggests replies, reads terms and dates from documents you file, and drafts updates. These are suggestions. Nothing is sent, filed or changed on a deal without your click, every suggestion shows the words it came from, and you are responsible for what you send and for the accuracy of anything you rely on. AI features draw on a monthly spending limit you control.

What Homies is not

• Homies does not provide MLS data, comparable sales or pricing opinions, and is not a substitute for your MLS or for a broker's judgment.
• Calls inside Homies are never recorded or transcribed.
• Homies is not a document-signing service, and the copyrighted forms of a state or local association may not be uploaded, filled or signed in Homies unless your licence with that association allows it. Executed copies you receive may be stored.

Your responsibilities

• Fair Housing. Homies flags wording that may read as steering, but compliance with the Fair Housing Act and your state's law, in every message and listing description, is yours.
• Your clients' information. You confirm you may store and use the information you enter about clients, leads and partners, and that you will honor their requests to see, correct or delete it.
• Your sign-in. Sign-in codes are personal; tell us at once if you think an account was used without permission.
• Acceptable use. No unlawful, deceptive or abusive use, no scraping, and no attempt to reach another agent's data.

Your data

Your client information belongs to you. We use it only to run Homies, as the Privacy Policy describes. You can request an export of your data at any time, and you can ask us to delete your account; deletion removes your records and files within 30 days except what the law requires us to keep.

Availability and changes

We work to keep Homies available and back up its data, but we do not promise uninterrupted service. We may change features with notice in the app. If we discontinue Homies, you will have at least 60 days to export your data.

Limits on liability

Homies is provided as is. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim is limited to the subscription fees you paid in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of Arizona, and disputes are heard in the courts of Maricopa County, Arizona. [Tovah to confirm the state and county with counsel.]
